Castle not only passionately comply with India's Copyright Act 1957, Information Technology Act 2000, and IT Rules 2021 but also upholds the rights of content creators and copyright holders across the globe. When Castle's Indian users are streaming K-dramas, Bollywood blockbusters, or regional films on the company's downloadable Android app they can do so knowing that their content environment is a safe, secure and trusted one - guided by this DMCA Policy with its (c) structured response procedures and robust policy that includes no-nonsense guidelines for submitting notices of copyright infringement.

1. Submitting a Copyright Infringement Takedown Notice

We do however require a proper, official takedown request to be posted so you could actually get it approved if you're the copyright owner or an authorized representative acting on behalf of one and believe that any material placed on Castle violates your rights. Specifically, we require the following:

Identification of the copyrighted work that you claim has been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at the Site;

Identification of the material on our services that you claim is infringing and that you request us to remove;

Sufficient information to permit us to locate such material;

Your physical address, telephone number and email address;

A statement from you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or law;

A statement from you (by signing with your electronic signature) that all information contained in your notice is accurate and under penalty of perjury.

2. Takedown Request Processing

All of the legitimate takedown notices to our India-based copyright compliance unit, including those coming from non-English speaking foreign IP holders should be seen by our experts. Notices that are not fully compliant will be acknowledged within 48 business hours with details of what information or documents are required to make that notice compliant at the sole discretion our designated agent.

Pursuant to the provisions of the India IT Rules 2021, in event that claim is approved, we will be required to inform the content provider/passenger who posted / published such content and block or remove any infringing content with-in 72 hours. If, the user feels that we were wrong to remove the content, we will also tell them of their ability to submit a counter-notice as long it meets all legal requirements.

3. Rejection of Invalid Requests & Repeat Infringer Policy

Castle may reject any incomplete, inaccurate or falsely-claimed notice of infringement. We also reserve the right to suspend your account immediately if you share or post unlawful content on our site more than once.

Notice: This policy only applies to requests that are copyright-infringement related. As per our Terms of Service, all other grievances or complaints regarding offensive content, privacy violation or breach of terms and conditions are directed to the designated grievance officer accessible via the in-app support channel.

4. Policy Updates

This DMCA Policy will be reviewed regularly to accommodate changes in the operation of the platforms, new laws and regulations. We’ll surface any material changes to Castle terms directly in the Settings > Legal for our Indian Castle users, with a prominent notice announcing when the changes has been revised. Continued use of Castle is evidence of your acceptance of our modified DMCA Policy.
